Terms & Conditions

1. These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the Terms and Conditions and by participating, all entrants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy for your information.

3. ELIGIBILITY

The promotion is open to residents of the United Kingdom (England, Wales, Scotland and Northern Ireland) and the Republic of Ireland aged 18 years or over only, as a parent, grandparent or guardian on behalf of their child aged between 4 and 12 only, except:

(a) employees of the Promoter or its holding or subsidiary companies;

(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the promotion or its administration; or

(c) members of the immediate families or households of (a) and (b) above.

4. THE PROMOTION

4.1 The title of the promotion is Fruit Shoot for the Moon Draw

4.2 The promotional period will open 08.00 GMT on the 1st July 2021 (the “Opening Date”) to 20.00 GMT on the 30th September 2021 (the “Closing Date”) inclusive (the “Promotional Period”). All entries received after the Closing Date are automatically disqualified.

4.3 Promotional Products include:

4.4 Parent/grandparent/guardian only to enter on behalf of child aged 4-12 years.

4.5 To enter residents of Great Britain only:

4.5.1 Purchase a Promotional Pack of Fruit Shoot and scan the QR code to visit www.fruitshootforthemoon.co.uk, confirm country of residence and complete the form (including name, email address, Dream Thing Category and confirmation their child is aged between 4 and 12 years old).

4.6 To enter residents of Northern Ireland only:
4.6.1 Visit www.fruitshootforthemoon.co.uk , confirm country of residence and complete the form (including name, email address, , Dream Thing Category and confirmation their child is aged between 4 and 12 years old).

4.7 To enter, residents of the Republic of Ireland only:
4.7.1 Visit www.fruitshootforthemoon.co.uk, answer the qualifying question correctly, confirm country of residence and complete the form (including name, email address, Dream Thing Category and confirmation their child is aged between 4 and 12 years old).

4.8 Maximum of two (2) entries every 7 days per person per email address only, taken from day of first entry. Maximum of one (1) prize per household for the entirety of the Promotion. Anyone found attempting to bypass this rule by, for example, using multiple email addresses to enter will be disqualified. If you win one (1) prize, please do not continue to enter the prize draw, as you will not be eligible to win any further prizes.

4.9 Entrants must have Internet access to enter this Promotion.

4.10 Purchase of Promotional Pack is necessary to enter the Promotion in GB only (no purchase necessary route available for residents of Northern Ireland, see clause 4.6.1 and Republic of Ireland, see clause 4.7.1).

4.11 GB entrants must retain their Promotional Pack and receipt as proof of purchase. The Promotor, acting in its sole discretion, may request evidence of this before awarding any prizes.

4.12 During the main Promotional Period, the 105 prizes will be randomly assigned to winning moments via a secure, independently verified computer programme and based on an algorithm with prizes seeded over the promotional period. If your time of entry matches the guaranteed winning slot or you are the first person to enter after the time slot has passed, then you will be awarded the prize. If no entry is received between one winning moment and the next, the prize will be reallocated to the mop up draw. All prizes are available to be won. Any prizes unclaimed following the close of the main promotional period will be re-allocated to the mop up draw.

4.13 Proof of sending will not be accepted as proof of delivery or receipt of entry. Incomplete, illegal, illegible, misdirected or late entries will not be accepted. The Promoter takes no responsibility for entries that are delayed, incomplete or lost due to technical reasons or otherwise.

4.14 Entrants who do not give correct details or those who make an entry on someone else’s behalf will be disqualified, at the Promoter’s discretion.

5.1 The prize consists of:

5.1.1 5 x Dream Thing Prizes: 5 winners will receive a bespoke dream experience worth up to £5,000 for a child aged between 4 and 12 only and their parent or grandparent or guardian. Subject to feasibility. See 5.5.1. – 5.5.10. for further detail; and

5.1.2 100 x runner-up Family Experiences. Each family experience is for a family of four which is classified as EITHER 2 adults and 2 children or 1 adult and 3 children. See 5.5.11. for further detail.

5.2 There are 105 prizes to be won over the entire Promotion.

5.3 The Prize is supplied by the Promoter and administered through its agents (the “Prize Administrator”):

5.3.1 Family Experiences to be administered through Savvy Marketing, 15-17 High Ct Ln, Leeds LS2 7EU and Active Consultancy, Active House, 51 Wolsey Rd, Esher KT10 8NT; and

5.3.2 Dream Thing Experiences to be administered through Savvy Marketing, 15-17 High Ct Ln, Leeds LS2 7EU and Promo Veritas Ltd, Monument House, 215 Marsh Road, London, HA5 5NE, UK

5.4 Subject to 8.1. the Promoter shall have no liability in relation to any prize provided by a third-party provider.

5.5 Further Prize Details and Conditions:

5.5.1 The bespoke Dream Thing experiences will be up to the value of £5,000 and cannot exceed this amount.

5.5.2 The Dream Thing experience must fall within the following six categories:

5.5.2.1 ARTS, CRAFTS & DRAMA

5.5.2.2 NATURE & SCIENCE

5.5.2.3 HISTORY & LITERATURE

5.5.2.4 MUSIC, FILM & ENTERTAINMENT

5.5.2.5 SPORTS & GAMES

5.5.2.6 TECHNOLOGY & TRANSPORT

(each a “Dream Thing Category”, together the “Dream Thing Categories”)

Child Age Restrictions: minimum age varies with location, details provided during curation.

5.5.3 Each winner in collaboration with their child may choose a destination and activities to make up their dream experience. The Prize Administrator will curate the winners’ desired destination and activities in line with budget and realistic practicality of the dream experience.

5.5.4 All prizes subject always to availability and feasibility of chosen experience. Prize Administrator reserves right to amend any dream experience to ensure safety and suitability for all participants. Promoter and Prize Administrator not liable for unavailability of chosen dream experience.

5.5.5 Any remaining amount not spent on travel, accommodation and activities will not be offered as a cash alternative.

5.5.6 Each dream experience will be created and planned with the winner upon acceptance of the Prize.

5.5.7 Destinations, dates and activities are subject to availability at the time of booking.

5.5.8 Each dream experience must be taken within 12 months of prize acceptance, unless the Promotor, acting in its sole discretion, agrees otherwise. Destination and preferred dates must be communicated a minimum of 6 weeks prior to proposed departure dates.

5.5.9 Each winner and any accompanying guests may require passports valid past the date of proposed return.

5.5.10 Each winner and any accompanying guests are responsible for any visas required to take the prize. If any winner/guests are unable to obtain a visa, the Promoter is not liable.

5.5.11 The Family Experiences are also categorised by Dream Thing Categories. Winners must select their preferred Dream Thing Category and then choose from ONE of the following experiences available:

5.5.11.1 ARTS, CRAFTS & DRAMA:

5.5.11.2 Aerial Workshop
i. The prize is an aerial workshop experience for 4 people (2 adults and 2 children).
ii. Anyone under the age of 18 must be accompanied by a participating adult.
iii. Age restrictions depend on the location chosen, but usually ages 4 -15 are allowed.
iv. The experience is available at the following locations: Bankside, Battersea, Peckham, and Wimbledon.
v. The prize is valid for 12 months but is subject to the venues opening times and is subject to availability at time of booking.

5.5.11.3 Photography Workshop
i. The prize is a photography workshop experience for 4 people (2 adults and 2 children).
ii. Minimum age is 8.
iii. The experience is available at the following locations: Newcastle and Durham.
iv. The prize is valid for 12 months but is subject to the venues opening times and is subject to availability at time of booking.
v. You will need a camera that can have shutter speed, aperture, ISO and focus manually set i.e. DSLR or mirrorless.
vi. You will need to bring a tripod and torch.
vii. The experience involves walking a distance of under one mile, at a steady pace.
viii. The experience content, equipment used, and restrictions may vary.

5.5.11.4 NATURE & SCIENCE

5.5.11.5 Go Apes Net Adventure Experience
i. The prize is a Go Ape Nets Adventure Experience workshop experience for 4 people (2 adults and 2 children).
ii. Minimum age is 1. Anyone under the age of 18 must be accompanied by a participating adult.
iii. The experience is available at the following locations: Black Park, Moors Valley and Sherwood Forest.
iv. The prize is valid for 12 months but is subject to the venues opening times and is subject to availability at time of booking.
v. Forest doors open from February – November (weekends during February, March and November, and almost daily April – October).
vi. Footwear must be sturdy and suitable for the outdoors. No sandals, slip off shoes, open toes or heels.

5.5.11.6 Horse Riding Group Lesson
i. The prize is a Horse-Riding Group Experience workshop experience for 4 people.
ii. Minimum age is 4 – 7 depending on the centre.
iii. Anyone under the age of 18 must be accompanied by a participating adult throughout the experience.
iv. Height restrictions may also apply.
v. Maximum weight will vary between centres but will be under 16 stone.
vi. The participant should have some basic horse-riding experience.
vii. The experience is available UK wide including NI & ROI.
viii. The prize is valid for 12 months but is subject to the venues opening times and is subject to availability at time of booking.

5.5.11.7 Stargazing Experience
i. The prize is a Star Gazing Experience workshop experience for 4 people.
ii. Minimum age is 5.
iii. Anyone under the age of 18 must be accompanied by a participating adult throughout the experience.
iv. The experience is available at the following locations: Tomintoul, Glenlivet, Southwell, Cleethorpes, Chesterfield, Derby, Durham, Powys, and County Clare.
v. The prize is valid for 12 months but is subject to the venues opening times and is subject to availability at time of booking.

5.5.11.8 English Heritage 1-year family membership
i. The prize is an English Heritage, Scottish Historic or Welsh Heritage family membership for 1 year, for 4 people (2 adults and up to 6 children). Minimum age 5-17.
ii. Sites across the country include England, Scotland, Wales, N Ireland & Eire*
iii. The prize is valid for 12 months but is subject to the venues opening times and is subject to availability at time of booking.
iv. *Additional supplements apply for delivery to Eire. Maximum 2 adults.

5.5.11.9 National Trust 1-year family membership
i. The prize is a one-year National Trust Membership for two adults and up to five children.
ii. Minimum age 5-17.
iii. Sites across the country include England, Scotland, Wales, N Ireland & Eire*
iv. The prize is valid for 12 months but is subject to the venues opening times and is subject to availability at time of booking.

5.5.11.10 Science Museum visit
i. The prize is a Science Museum/Gallery experience for 4 people (2 adults and 2 children) and £50 travel/spending money.
ii. Anyone under the age of 18 must be accompanied by a participating adult throughout the experience.
iii. The experience is available at the following locations: London, Lisburn, Dublin, and Dundee.
iv. The prize is valid for 12 months but is subject to the venues opening times and is subject to availability at time of booking.

5.5.11.11 Wildlife Fun at the Zoo/Aquarium
i. The prize is a Zoo/Aquarium experience for 4 people (2 adults and 2 children).
ii. The child ages are down to the discretion of the location chosen, but typically the minimum age is 5-17.
iii. Anyone under the age of 18 must be accompanied by a participating adult throughout the experience.
iv. The experience is available at the following locations:

i. The prize is a UK City Bus Tour experience for 4 people.
ii. Anyone under the age of 18 must be accompanied by a participating adult throughout the experience.
iii. The experience is available at the following locations: Bath, Belfast, Bournemouth, Brighton, Cambridge, Cardiff, Chester, Derry-Londonderry, Edinburgh, Glasgow, Inverness, Llandudno, London, Norwich, Oban, Oxford, Scottish Borders, Stratford-upon-Avon, and York.
iv. The prize is valid for 12 months. Dates that tours are available may vary according to location.

5.5.11.14 Warwick Castle day out
i. The prize is a Warwick Castle Day Out experience for 4 people (2 adults and 2 children).
ii. Child ages 3-11 years.
iii. Anyone under the age of 18 must be accompanied by a participating adult throughout the experience.
iv. The experience is available at the following locations: Warwick.
v. The prize is valid for 12 months but is subject to the venues opening times and is subject to availability at time of booking.

5.5.11.15 Hampton Court Palace day out
i. The prize is a Hampton Court Castle Day Out experience for 4 people (2 adults and 2 children).
ii. Child ages 5-15 years.
iii. Anyone under the age of 18 must be accompanied by a participating adult throughout the experience.
iv. The experience is available at the following locations: Hampton Court.
v. The prize is valid for 12 months but is subject to the venues opening times and is subject to availability at time of booking.

5.5.11.16 MUSIC, FILM & ENTERTAINMENT

5.5.11.17 Family Cinema tickets
i. The prize is a Cinema experience for 4 people (2 adults and 2 children) and £50 travel/spending money.
ii. Child ages 3-12 yrs.
iii. Anyone under the age of 12 must be accompanied by a participating adult throughout the experience.
iv. The experience is available at the following cinemas: Cineworld, Merlin, The Light, ODEON or Vue.
v. Certain cinemas are excluded including most West End cinemas. Vue, Merlin and The Light tickets are not accepted in ROI.
vi. Vouchers cannot be used for 3D or IMAX films.
vii. Special screenings may also be restricted. Please contact us for further details on included and excluded cinemas.
viii. Please note all tickets are sent to your email address and not as a physical ticket.
ix. The prize is valid for 12 months but is subject to the venues opening times and is subject to availability at time of booking.

5.5.11.18 Open Air Cinema Family ticket
i. The prize is an Open-Air Cinema experience for 4 people (2 adults and 2 children)
ii. Child ages 3-12 yrs.
iii. Anyone under the age of 12 must be accompanied by a participating adult throughout the experience.
iv. Child admission only available on certain performances.
v. The experience is available at the following locations: UK, Northern Ireland and Republic of Ireland.
vi. Vouchers cannot be used for 3D or IMAX films.
vii. Please note all tickets are sent to your email address and not as a physical ticket.
viii. The prize is valid for 12 months but is subject to the venues opening times and is subject to availability at time of booking. Available April-October.

5.5.11.19 Harry Potter Studio Tour London
i. The prize is a Harry Potter Studio Tour for 4 people (2 adults and 2 children).
ii. Child ages 4-15 yrs.
iii. Anyone under the age of 18 must be accompanied by a participating adult throughout the experience.
iv. The experience is available at the following locations: London.
v. The prize is valid for 12 months but is subject to the venues opening times and is subject to availability at time of booking.
vi. Some rides may not be suitable for people with physical disabilities.
vii. Height and weight restrictions may apply.

5.5.11.20 SPORTS & GAMES

5.5.11.21 Laser game/Laser Quest
i. The prize is a Laser Games experience for 4 people (2 adults and 2 children) and £50 travel/spending money.
ii. Child ages 6-7 yrs.
iii. Anyone under the age of 7 must be accompanied by a participating adult throughout the experience.
iv. The experience is available at the following locations: Kent, Hampshire, West Midlands, Avon, Gwent, Mid Glamorgan, Lancashire, Redcar, Inverness-shire, Newry and Ross-shire.
v. The prize is valid for 12 months but is subject to the venues opening times and is subject to availability at time of booking.
vi. May not be suitable for people with physical disabilities.

5.5.11.22 Ten-pin Bowling
i. The prize is a Tenpin Bowling experience for 4 people (2 adults and 2 children) and £50 travel/spending money.
ii. Child ages 4-12 yrs.
iii. Anyone under the age of 18 must be accompanied by a participating adult throughout the experience.
iv. The experience is available at the following locations: Acton, Bexleyheath, Birmingham Star City, Blackburn, Bristol, Camberley, Cambridge, Cardiff, Castleford, Cheshire Oaks, Chichester, Colchester, Coventry, Croydon, Derby, Doncaster, Dudley, Eastbourne, Edinburgh Fountain Park, Exeter, Falkirk, Feltham, Glasgow, Gloucester, Ipswich, Kingston, Leamington Spa, Leeds, Luton, Manchester Parrs Wood, Manchester Printworks, Northampton, Nottingham, Plymouth Barbican, Rochdale, Southampton, Southport, Stafford, Stoke, Swansea, Swindon, Telford, Warrington, Worcester, Wrexham and York.

5.5.11.23 Trampolining Experience
i. The prize is a Trampolining experience for 4 people (2 adults and 2 children) including £50 travel/spending money.
ii. Minimum age 5 years old. Children under 18 must be accompanied by an adult.
iii. Some parks do offer toddler sessions which are for ages 3 and up. If you are interested in this, please get in touch and we will confirm availability.
iv. The experience is available at the following locations: UK, Northern Ireland and Republic of Ireland.
v. The prize is valid for 12 months.

5.5.11.24 Snowboarding Recreational Session
i. The prize is a Snowboarding experience for 4 people (2 adults and 2 children) including equipment.
ii. Child ages 4-8 yrs.
iii. The experience is available at the following locations: UK, and ROI.
iv. Most centres require a certain standard of snowboarding in order to take part in a recreational session.
v. The prize is valid for 12 months but is subject to the venues opening times and is subject to availability at time of booking.
vi. May not be suitable for people with physical disabilities.

5.5.11.25 Football Ground Tour
i. The prize is a Football Ground Tour experience for 4 people (2 adults and 2 children).
ii. Minimum age 8 but it may vary across clubs.
iii. The experience is available at the following locations: UK.
iv. Selected dates excluding match days. Content of the package varies between clubs. Tours cannot be arranged at all clubs. If a tour cannot be arranged to the satisfaction of the winner an alternate prize of equal of greater value will be awarded.
v. The prize is valid for 12 months but is subject to the venues opening times and is subject to availability at time of booking.

5.5.11.26 Premiership Rugby Tickets
i. The prize is a Rugby Premiership Ticket experience for 4 people (2 adults and 2 children).
ii. Minimum age 8 but it may vary across clubs.
iii. The experience is available at the following locations: UK and ROI.
iv. The prize is valid for 12 months. You can select any Premiership Club match subject to availability.

5.5.11.27 TECHNOLOGY & TRANSPORT

5.5.11.28 Beaulieu Motor Museum
i. The prize is a Beaulieu Motor Museum experience for 4 people (2 adults and 2 children).
ii. Child ages 5 -16 years.
iii. The experience is available at Beaulieu Motor Museum only.
iv. The prize is valid for 12 months.
v. Some rides may not be suitable for people with physical disabilities.
vi. Height restrictions may apply to some rides.

Child Age Restrictions: minimum age varies with location, details provided after prize selected.

5.6 Unless otherwise stated or arranged with the Prize Administrator, all expenses incurred by the winners in the general use and/or enjoyment of the Prize, including but not limited to food, drink, travel and accommodation, are the sole responsibility of the winners.

5.7 Prize is not transferable and there is no cash alternative.

5.8 The Promoter reserves the right to replace the Prize with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control makes it necessary to do so.

6. WINNER NOTIFICATION

6.1 Winners will be notified instantly via the microsite when they to enter and will be required to confirm their name, email address, Dream Thing Category and enter their telephone number. Family Experience winners will then need to select their chosen family experience. All winners will receive a winning confirmation email (the “Winning Confirmation Email”), sent to the email address provided at the time of entry. It is the responsibility of entrants to check junk/spam folders to ensure they are in receipt of any communications. Further detail below:

6.1.1 Dream Thing Prizes: each winner will be contacted via the email address provided on entry within 10 working days of the Winner Confirmation Email and will be required to respond via email within 7 working days of the Winner Confirmation Email to confirm eligibility and acceptance of the prize. GB entrants may (at the Promotor’s sole discretion) also be required to provide a copy of the itemised till receipt(s) that was issued when the Promotional Packs were purchased. They will then have their dream experience curated from a category of ARTS, CRAFTS & DRAMA, NATURE & SCIENCE, HISTORY & LITERATURE, MUSIC, FILM & ENTERTAINMENT, SPORTS & GAMES, TECHNOLOGY & TRANSPORT within 30 working days of confirmation and acceptance. Receipt may not be returned so please ensure a copy is taken before sending.

6.1.2 Family Experience Prizes: each winner will be contacted via the email address provided on entry within 10 working days of the Winner Confirmation Email with further details on the prize they have selected curated from a category of ARTS, CRAFTS & DRAMA, NATURE & SCIENCE, HISTORY & LITERATURE, MUSIC, FILM & ENTERTAINMENT, SPORTS & GAMES, TECHNOLOGY & TRANSPORT. Winners must respond within 7 working days of the Winner Confirmation Email via email to confirm eligibility and accept their prize.

6.2 Verification of winner and child’s age, identity and address will be required within 10 working days of prize acceptance before any prizes are awarded.

6.3 Winners have 7 working days from the Winner Confirmation Email to confirm acceptance of their Prize via email. In the event that a winner does not respond to the initial contact within 7 working days, the Promoter reserves the right to disqualify that winner.

6.4 If a winner is disqualified or is ineligible, the Promoter reserves the right to re-allocate any unallocated prizes via a mop-up draw, see clause 6.7. below.

6.5 All requested details must be provided otherwise the Promoter reserves the right to reallocate the prize with no liability.

6.6 The Promoter does not accept any responsibility in the event a winner does not, or is not able to, take up their prize.

6.7 Mop up draw for all unclaimed prizes from the promotional period to take place on 18th October 2021 (the “Draw Date”) via a randomised computer process. All unsuccessful entries received in the Promotional Period will be entered into the mop up draw. Winners will be notified by email within 10 working days of the Draw Date and will be required to respond within 7 working days of this initial notification to confirm eligibility and acceptance of the prize. In the event a winner does not respond to this notification within 7 working days of initial contact, the Promoter reserves the right to select an alternative winner from all remaining entries, with the originally selected winner forfeiting their right to the prize. It is the responsibility of entrants to check junk/spam folders to ensure they are in receipt of any communications. The process will repeat for 3 months after the mop up draw until an eligible winner is able to claim the prize. At the end of the 3 months, all remaining prizes will become null and void.

7. PRIZE DELIVERY

7.1 Please allow 30 working days from valid acceptance for the Dream Thing Prizes to be organised with the Prize Administrator. Delivery of the Family Experiences prizes will vary per experience chosen, further detail to be provided on acceptance of prize.

7.2 If any prizes are unable to be organised due to inaccurate details or delay on the part of the winner, the Promoter reserves the right to withdraw and reallocate the prize entitlement with no liability. .

7.3 If delivery will be delayed due to the Covid-19 pandemic and resulting Government restrictions all winners affected will be contacted by the Promoter or the Prize Administrator and kept updated of any unavoidable changes and revised delivery dates.

8. LIMITATION OF LIABILITY

8.1 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected. For the avoidance of doubt, this clause 8.1 shall also apply in respect of any prize provided by a third-party provider, in this case the Prize Provider.

9. DATA PROTECTION

9.1 By entering the promotion, you agree that any personal information provided by you with the promotion entry may be held and used only by the Promoter or its agents and suppliers to administer this promotion.

9.2 If required by a regulatory authority, and/or if we consider it lawful, necessary or appropriate to do so, we may elect to make available a list of winners’ surnames and counties to members of the public or regulators who request such details within 3 months of the closing date of this Promotion. Entrants can object to disclosure, or request that disclosure be limited in scope by emailing britvicteam@getsavvy.com. We may nevertheless disclose the information to the Advertising Standards Authority if required to do so. You may request a copy of the winner’s list by emailing britvicteam@getsavvy.com. We reserve the right to refuse any or all such requests.

9.3 Promotion winners agree that the Promotor may use the name, image and town or county of residence information to announce a winner of this promotion and for any other reasonable and related promotional purposes. Winners further agree to participate in any reasonable publicity required by the Promotor.

9.4 Your personal details will at all times be kept confidential and in accordance with current Data Protection legislation. 10. GENERAL

10.1 By entering the Promotion, all entrants hereby grant the Promoter (or the Promoter’s designee) the exclusive right to film, tape, sound record and photograph all their activities in connection with the Promotion and (if applicable) any prizes. Everything filmed, taped or recorded by the Promoter (or the Promoter’s designee) shall be known as “Footage”. All entrants hereby irrevocably and unconditionally assign to the Promoter with full title guarantee (and by way of present assignment of present and future rights) all intellectual property rights in any “Footage” throughout the world for the full unexpired period of such rights and all renewals, reversions and extensions of such period as may be provided under any applicable law throughout the world.

10.2 Instructions provided at the point of entry form part of the Terms and Conditions of this Promotion. In the event of a conflict, these terms and conditions take precedence.

10.3 The Promoter reserves the right to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant if the Promoter has any reason to believe that there has been a breach of these Terms and Conditions, or if it has any reason to believe that efforts have been made to distort the competitive process or spirit of the Promotion or otherwise where a participant has gained unfair advantage in participating or won using fraudulent means, the Promoter may, at its sole discretion, reserve the right to exclude any entrant from participating in the promotion.

10.4 If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions (including but not limited to global or regional health crises, weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and acts of God), the Promoter will not be liable for any failure to perform or delay in performing its obligations.

10.5 It is the responsibility of the entrant to provide their correct, up-to-date details when entering the Promotion and/or confirming acceptance of the prize in order for their prize to be processed. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

10.6 The Promoter has no control over communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant’s entry to the Promotion.

10.7 Bulk entries made from trade, consumer groups or third parties will not be accepted. Entries via third parties or syndicates, entries by macros or other automated means and entries which do not satisfy the requirements of these Terms and Conditions in full will be disqualified. If it becomes apparent that a participant is using a computer(s) or multiple aliases to circumvent this condition by, for example, the use of 'script', 'brute force', masking their identity by manipulating IP addresses, using identities other than their own or any other automated means to increase that participant's entries into the Promotion in a way that is not consistent with the spirit of the Promotion, that person's entries will be disqualified and any prize award will be void.

10.8 The decisions of the Promoter are final and binding in all matters relating to the Promotion and no correspondence will be entered into.

10.9 If any clause or provision of these Terms and Conditions is declared by a court to be illegal, invalid or unenforceable, this declaration shall not affect the validity and enforceability of any other clause or provision within.

10.10 Entrants acknowledge that other entrants may submit entries that may be similar to theirs, and that they will not be entitled to any compensation or right to negotiate with the Promoter over such matters.

10.11 The Promoter reserves the right to, at its sole discretion, disqualify any entries containing:
(a) content deemed to be wholly inappropriate, discriminatory or illegal, including but not limited to obscene, indecent, defamatory, malicious, racist, sexist, homophobic, harassing, threatening and/or offensive, inclusive of nudity and/or pornography, sexual, violent and fraudulent in nature.
(b) any activity or behaviour which causes, encourages or promotes danger or a threat to the health and safety of the entrant and/or others.
(c) any activity or behaviour which promotes or advertises goods and/or services, including competitor products, for any form of remuneration.
(d) any attempt to impersonate another person or include persons who have not given permission to feature in the entry.
(e) prominent featuring of any trademark or copyright material not owned or licenced by the promoter or any third party connected to the promoter for the purposes of the promotion.

10.12 The terms and conditions of this Promotion, and any disputes arising therefrom, shall be subject to English law and the exclusive jurisdiction of the English and Welsh courts unless your residential address is in Scotland, N.Ireland or Republic of Ireland where local law applies.
